GENERAL TERMS AND CONDITIONS

1. Preamble
The general terms and conditions of the company Wolfgang Höfler (HWO) applies for deliveries and services, which HWO effects to the client, as well as all involved deliveries in this context (especially software).
They also apply for future businesses, even though when there's no explicit reference to these terms.
HWO only places contracts or accepts orders considering this general business and delivery conditions.
The liabilities of HWO only conforms to the volume and the matters of an accepted order or to a certificated order-confirmation and these "general terms and conditions" in conformable clauses, adequate to the sort of order.
As far as general terms and conditions of the orderer are contradictory to these general terms, they former applies as not agreed and hereby will be expressly disagreed.

2. Quotations
Offers are basically without engagement. The contract will not be effective until HWO has sent a written confirmation of an order to the client.

3. Placing of order
The execution of workings, which will be assigned from a contractual partner, in the following "Orderer", to a service company for information processing, below "service provider", happens via written order confirmation (contract).
This contract will be signed from both partners with the company's official mark, to show the mutual will agreement in reference to the order volume, the prices and the deadlines.
The agreement can also occur in a different written form. (e.g. an order confirmation)

Subject matters of a contract can be, for example:
